<p><strong>Helpful tips for a successful interview:</strong><br />
The U.S. sponsoring spouse</p>
<ul>
<li>should carry photo identification such as driver&#8217;s license or passport and proof of legal status such as a birth certificate, naturalization certificate, passport, permanent resident.</li>
<li>If you have common children, USCIS is much less likely to question whether your marriage is bona fide.</li>
</ul>
<p>You may be asked general questions about your married life ( e.g. where you met, when and why you decided to get married, etc. Back up your answers with documents that illustrate bona fide marriage, such as rental agreements, joint utility bills etc. )</p>
<p><strong>Fraud suspected?</strong></p>
<p>If the officer suspects that your marriage is fraudulent, you will be meeting the fraud unit instead.</p>
<p><strong>Possible fraud red flags</strong></p>
<p>Sometimes, suspicion arises  because of people&#8217;s personal characteristics or lifestyle and may have to go through fraud interview:</p>
<ul>
<li>not  sharing a common language</li>
<li>having large differences in age, class, cultural, religion educational background or</li>
<li>not  living at the same address</li>
</ul>
<p>An officer will interview you and your spouse separately and intensively. The officer will compare<br />
the results of your two interviews.</p>
<p>&nbsp;</p>
<p><strong>Marital issues</strong></p>
<p>If you have serious marriage problems, you can mention them and the detailed steps you are taking<br />
to deal with them  ( eg marriage counseling ). In some cases, this action can be a strong evidence of a real, bona fide marriage. If the officer is not satisfied with that, you should request that your interview be rescheduled and reappear with an attorney.</p>
<p><strong>If you have received a court ordered legal separation or filed for divorce, your green card will most</strong><br />
<strong> likely be rejected.</strong></p>
<p><strong>Exception</strong>: If your U.S. spouse is abusive (physical or emotional cruelty), you may be<br />
able to file a self-petition on Form I-360 even if you are divorced. You must file I-360<br />
before the final divorce, or within 2 years of the final decree if you can prove that the divorce<br />
was connected to the abuse. You don&#8217;t need your U.S. spouse&#8217;s help or signature or any support any more<br />
in such cases.</p>

			<content:encoded><![CDATA[<p>The fiscal year 2011 (FY11) on October 1, 2010 is also  the start of the annual  DV lottery. This one os for  for FY12. The FY12 lottery program will allocate 50,000 immigrant visa numbers to individuals from countries with low rates of immigration to the United States.</p>
<p>Major Points:</p>
<ul>
<li>Applications begin noon, Eastern Time (U.S.), October 5, 2010 through noon, ET, November 3, 2010.</li>
<li>All applications are electronic, i.e. online.</li>
<li>Start early, otherwise you may have technical difficulties if you wait till the end times.</li>
<li>If you are selected, you will be notified via email starting April 2011.</li>
<li>Green Card Visas start being issued to winners  starting Sept 2011 and last until all have been issued.</li>
<li>One must leave for the US no later than Sept 2012.</li>
<li>Instructions are on the DOS website at http://www.dvlottery.state.gov/, the only official site.</li>
</ul>
<p>The DOS selects more than 50,000 applicants as lottery &#8220;winners.&#8221; and winner letters are issued to more than 100,000 applicants. Not everyone who receives the winner notification can qualify for a green card, due to procedural issues and educational and/or job requirements. Other winners will simply not take the additional steps needed to obtain their green cards.</p>
<p>The winner letters have detailed instructions on how to proceed. Individuals who are outside the United States will need to process for their immigrant visas at the appropriate U.S. consulates abroad.</p>
<p>Those who are within the United States will have the option of either an adjustment of status to permanent residence in the United States or consular processing. Of course, <strong>you must meet all standard legal requirements</strong> for either the adjustment of status or consular processing procedures in order to obtain a benefit based upon the lottery selection.</p>

It may not be possible to  use education gained while working with one&#8217;s employer as a requirement for an employer-sponsored position in a PERM / LC case.</div>
<div>The labor certification case must be based upon the employer&#8217;s actual minimum education and/or experience requirements for the position. If an individual was hired prior to obtaining a certain degree, then that degree normally would not be regarded as a minimum requirement for the job.</div>

<div><strong>Q: Is Employer-Paid Education a Problem for GC Sponsorship ?</strong></div>
<div>The PERM application asks whether the employer paid for any of the beneficiary&#8217;s education or training that is necessary to satisfy the employer&#8217;s job requirements for the position. If the answer to this question is yes, the employer must be offering similar training to domestic applicants for that particular position.So, normally, it will not be possible to utilize education paid for by the sponsoring employer as a requirement for the offered position in a PERM / LC.</div>

			<content:encoded><![CDATA[<p>The DOS has provided an online status check for those who applied for DV-2010</p>
<p>To use the online system, you must:</p>
<ol>
<li> the confirmation  number received following submission of the DV lottery  application.</li>
<li> The name and birth date information.</li>
</ol>
<p>Selection alone does not grant individuals or immediate family members U.S. permanent residence. You must move forward either to adjust their status to permanent residence in the United States, or to complete consular processing for an immigrant visa at the appropriate U.S. consulate abroad within the time-frames required by law. You must meet general requirements for these procedures, as well as requirements for the DV lottery. More people are granted winner letters than ultimately receive permanent residence under the DV program.</p>

<p>Britain has reversed its open-door policy as public concern grew over the scale of immigration since 2004, when Poland and seven other Eastern European nations joined the European Union, gaining the right to work without restriction in the U.K. Brown has focused his clampdown on migration from outside Europe, restricting both family and work visas.</p>
<p>Applicants can shave two years off their wait by doing approved volunteer work.</p>

<h2>Employer Nomination Scheme (Subclass 121/856)</h2>
<h2>Who is this visa for?</h2>
<p>This visa is for Australian employers who want to sponsor highly skilled workers for a permanent visa to work in Australia. The employees can be either:</p>
<ul>
<li>highly skilled workers from overseas</li>
<li>highly skilled temporary residents currently in Australia.</li>
</ul>
<h2>What does this visa let you do?</h2>
<p>This visa allows you and any dependent family members included in your visa application to live as permanent residents in Australia.</p>
<p>Australian permanent residents can:</p>
<ul>
<li>live and work in Australia on a permanent basis</li>
<li>study in Australia at school or university</li>
<li>receive subsidised healthcare through Medicare and the Pharmaceutical Benefits Scheme (PBS)</li>
<li>access certain social security payments (subject to waiting periods)</li>
<li>be eligible for Australian citizenship (subject to the residency eligibility criteria)</li>
<li>sponsor people for permanent residence.</li>
